The basic elements every contract should contain are as follows:

  1. An offer, which encompasses the duties and responsibilities of each party
  2. Acceptance; the offeree must decide whether to accept or reject the proposal/offer.
  3. Awareness; for a contract to be binding, the involved parties must first be aware that they are entering into an agreement
  4. Legal capacity; all contracts are subject to the laws of the jurisdiction in which they operate
