Okay, so straight to the point: The tenth amendment gives us protection against the national government's doings things not listed in the constitution. The tenth amendment says and I quote, "The powers not delegated to the United States by the Constitution, nor prohibited to it by the states, are reserved to the states respectfully, or to the people." If you read this over a couple times, you will notice that it has all the parts in your question. Therefore, your answer is the tenth amendment!!!
