Why did early Americans write the constitution and the bill of rights?

The simplest answer is because they wanted to be ruled by a government that recognized the rights and power of the people being ruled. The bill of rights outlines and as much as possible guarantees what things are granted to everyone. It's not only freedom religion, assembly and speech. It is things like gun control, search and seizure, the right to trial, the right not to incriminate oneself by saying anything at all.

The constitution outlines how each of the governments divide up the power given to each of them. The most carefully written part has to do with the role of the federal government vs states rights.

The main reason why early Americans wrote the bill of right is because they needed to set up a new government and wanted to be sure it could not abuse their rights.

The so called "universal question" or "problem of universals" includes whether or not "properties" belonging to a person, place, thing, or idea really exist.

Realists on the subject believe that yes, properties exist and are distinct and that universals are real.

Nominalists believe that only particulars and individuals can exist, but deny and do not believe that universals are real.

Transcendental idealists do not believe that universals are real and that they only exist in the minds of rational beings.

Anicius Boethius introduced the problem of universals. John Duns Scotis argued for scotistic realism, that properties exist in reality.  William Ockham asserted that universals only exist in the human mind.
