The three degrees of murder are under the same room of killing but different by intentions :

1st Degree Murder is the intentional killing of someone, for it to be proved, the murderer had to premeditate killing his victim.

2nd Degree Murder is the intentional killing of someone but without the murderer premeditating killing his victim, so instead of waiting, they just killed the person on the spot.

3rd Degree Murder is when someone accidentally kills someone but at the same time commiting a crime, such as a drug dealer selling drugs to people but yet they didn't know that the person they gave it to may have been allergic to a certain material and they die.
