Confidentiality is considered one of the fundamental principles of the work of all physicians. Such as the “Criminal Code” and the “Civil Procedure Code”, prohibit the testimonies of people who need to keep secrets because of their profession, which therefore includes doctors.

The “Code of Medical Ethics”, the most updated version of which was published by the Federal Council of Medicine (CFM) in 2019, cites the issue of secrecy in its general provisions: “The physician will maintain secrecy regarding the information of which he has knowledge in the performance of their functions, except the cases provided for by law”.

With this information, we can conclude that medical confidentiality must be preserved, but there are loopholes that can be used.
