El 21 de mayo, Sucre posicionó a su ejército al este del Cerro Panecillo para atraer a los españoles al ataque y provocar una batalla fuera de la ciudad. En la noche del 23 al 24 de mayo, pasó por alto las posiciones de los españoles y giró hacia el noroeste para escalar las laderas del volcán Pichincha, subiendo a una altitud de más de 3.500 metros. La caballería no pudo escalar el empinado camino y, por lo tanto, quedó en la base del volcán.  En respuesta, Aymerich envió a los oficiales Carlos Tolrá y Nicolás López con tres batallones de infantería, dispuestos al ataque. El enfrentamiento, que incluyó disparos y combate cuerpo a cuerpo, se saldo con cuatrocientos muertos realistas y doscientas del lado de los patriotas ecuatorianos.

Un día después, el 25 de mayo de 1822, los españoles firmaron la rendición, con lo cual Ecuador fue liberado de la corona española y la guerra terminó.
