"A tort resulting from an injury following a failure to use reasonable care is a negligent tort."

Negligence is a civil tort that happens when someone violates their duty of care to another and causes that person to experience hardship or incur legal harm. The negligent tort consists of four components. A duty of care is, in essence, the obligation a party has to another party to exercise reasonable care under the circumstances. Unless the entity that owed a duty of care violated that duty in some way, one will not have a case. The third element of any successful negligence-based case is causation. One must show how they would not have been harmed but for the liable party's acts in order to prove causation. Damage is the fourth and final component of any successful personal injury claim. Actual damages must have been suffered as a direct and immediate result of the negligent behavior of the liable party.
